Before the meeting could be called to order, the following nominations, elections and appointments needed to be made:
The meeting was then turned over to Lance Kalfell who declared nominations or appointments open for Commissioner of Fallon Division of the Buffalo Rapids Irrigation District No. 2 with Barry Rakes being nominated and/or appointed by Jackson Dion. Lance Kalfell made a motion that all nominations cease, seconded by Jackson Dion, and a unanimous ballot be cast for Barry Rakes. Mr. Barry Rakes' commission was uncontested by any other opponent for the three-year term.
A unanimous ballot was cast for Barry Rakes, and it was,
RESOLVED, that Barry Rakes be and is hereby elected and appointed to the position of Commissioner of Fallon Division of the Buffalo Rapids Irrigation District No. 2, to hold office until the twelfth regular meeting to be held in May of 2025 and/or until his successor is elected and qualified.
Mr. Rakes accepts his position.
Lance Kalfell declared nominations or appointments open for President of the Buffalo Rapids Irrigation District No. 2. Barry Rakes was nominated by Jackson Dion. Jackson Dion made a motion, seconded by Lance Kalfell, that all nominations cease, and a unanimous ballot be cast for Barry Rakes.
A unanimous ballot was cast for Barry Rakes, and it was,
RESOLVED, that Barry Rakes be and is hereby elected and appointed to the position of President of the Buffalo Rapids Irrigation District No. 2, to hold office until the twelfth regular meeting to be held in May of 2023 and/or until his successor is elected and qualified.
Mr. Rakes accepts his position.
The meeting was turned back to President Barry Rakes. President Barry Rakes declared nominations open for Vice President of the Buffalo Rapids Irrigation District No. 2 with Jackson Dion being nominated by Lance Kalfell. Lance Kalfell made a motion, seconded by Barry Rakes, that all nominations cease, and a unanimous ballot be cast for Jackson Dion.
A unanimous ballot was cast for Jackson Dion, and it was,
RESOLVED,
that Jackson Dion be and is hereby elected and appointed to the position of
Vice President of the Buffalo Rapids Irrigation District No. 2, to hold office
until the twelfth regular meeting to be held in May of 2023 and/or until his
successor is elected and qualified.
Mr. Dion accepts his position.
Nominations were open for Secretary of the Buffalo Rapids Irrigation District No. 2 with Tim Kortum being nominated by Lance Kalfell. Lance Kalfell made a motion, seconded by Jackson Dion, that all nominations cease, and a unanimous ballot be cast for Tim Kortum.
A unanimous ballot was cast for Tim Kortum, and it was,
RESOLVED, that Tim Kortum be and is hereby elected to the position of Secretary of the Buffalo Rapids Irrigation District No. 2, to hold office until the twelfth regular meeting to be held in May of 2023 and/or until his successor is elected and qualified.
Mr. Kortum accepts his position.
Nominations were open for Treasurer of the Buffalo Rapids Irrigation District No. 2, with Jessica Schott being nominated by Jackson Dion. Jackson Dion made a motion, seconded by Lance Kalfell, that all nominations cease, and a unanimous ballot be cast for Jessica Schott.
A unanimous ballot was cast for Jessica Schott, and it was,
RESOLVED, that Jessica Schott be and is hereby elected to the position of Treasurer of the Buffalo Rapids Irrigation District No. 2, to hold office until the twelfth regular meeting to be held in May of 2023 and/or until her successor is elected and qualified.
Ms. Schott accepts her position.
All nominations being made and accepted, the First Regular Meeting of the Members of the Buffalo Rapids Irrigation District No. 2, at Terry, Prairie County, Montana, was called to order, held on the 11th day of May, 2022, at 7:00 p.m.
There were present and participating at the meeting:

Also present and participating were: Tim Kortum, Manager, and Jessica Schott, Treasurer.
President Barry Rakes called the meeting to order, stating that all necessary and advisable business be conducted during this time and that notice had been received by each Board Member.
Thereupon, President Barry Rakes announced that legal notice had been given and a quorum was present so that the meeting was legally and lawfully ready to transact business.
The Minutes and Resolutions from the April 20, 2022, Board Meeting, were approved without corrections and, or additions, by Lance Kalfell, seconded by Jackson Dion. All in Favor. Motion Carried.
FINANCIAL REPORT:
Jessica Schott presented current budget figures which included payroll and expenditures through May to all Board members for their review. A list of invoices to be paid was submitted and forms for the Prairie County Treasurer to transfer funds in the amount of $72,908.54, to cover payroll and invoices were signed. May 15th estimated payroll: $16,066.94, May estimated invoices $38,794.38, May 31st estimated payroll: $18,047.22. In addition, a transfer authorization sheet was signed for the transfer of $13,274.00 from Equipment & Emergency reserve account into District 2 Cash O & M to reflect the recent purchase of the canal lining material to be installed in Shirley canal. An additional transfer authorization sheet was signed for the transfer of $3,043.76 from Equipment & Emergency reserve account into District 2 Cash O & M, to reflect the amount of funds expensed to the construction of the new balancing machine. An investment transfer was signed to invest the remaining monthly District No. 2 cash balances in the amount of $377,302.08 with Prairie County Pool. Warrant numbers from April 22, 2022 to May 12, 2022 range from 26980 to 27022.
Ms. Schott informed all present that the price quote received from Intuit for updated QuickBooks software was much higher than in previous years, and stated she would be looking into cost-saving options for the program prior to losing payroll updates and support on the current version of QuickBooks on May 31st.
The treasurer's report was approved on a motion by Jackson Dion, seconded by Lance Kalfell. All in Favor. Motion Carried.
Jessica Schott then presented to
the Buffalo Rapids Irrigation District No. 2 Board of Commissioners, a resolution
to submit an application for grant funding through the Montana DNRC for the
Shirley Main Canal Rehab project. On a
motion made by Lance Kalfell and seconded by Jackson Dion, it was RESOLVED,
To submit an application for grant funding through the Montana DNRC's Renewable Resource Grant and Loan Program to fund Phase II of the Shirley Main Canal Rehab project, and to commit in-kind labor and minimal reserve cash to complete the project.
MANAGER’S REPORT:
Mr. Tim Kortum informed all present that preparations for the 2022 water season are almost complete, and he is planning for the Terry Division to start water in the next few days. Tom Magalsky has finished re-shaping the lateral north of Highway 10 in Shirley. After finishing the last of the ditch burning left in the Fallon and Shirley divisions, and installing the canal liner in Shirley, those divisions will be ready for water also.
Tim Kortum explained to the Buffalo Rapids Irrigation District No. 2 Board of Commissioners that during some line maintenance excavation just west of Terry, the pipeline connecting Tibbetts' and Dion's/Feickert Farms was hit by mistake, so a new valve was placed in the line to repair it.
Mr. Kortum also advised that Travis Choat has expressed plans to construct a private stretch of pipeline to run between the Buffalo Rapids right-of-way and neighbor Greg Foster's property. Mr. Kortum has been to the property and has determined that Mr. Choat's plans will not interfere with any Buffalo Rapids water delivery or cause any right-of-way obstructions, and that Mr. Foster is agreeable to this crossing. An easement will be drafted stating the agreement between Buffalo Rapids Irrigation District No. 2, Mr. Choat, and Mr. Foster, to allow Mr. Choat to construct this pipeline.
The members of the Board discussed and agreed to maintain the list of authorized signors for Buffalo Rapids Irrigation District No. 2 until the twelfth regular meeting to be held in April of 2023. On a motion made by Jackson Dion and seconded by Lance Kalfell:
BE IT RESOLVED,
That the Buffalo Rapids Project Irrigation District No. 2 Commissioners, be authorized to sign on all Buffalo Rapids accounts, including the Secretary of the Board Mr. Tim Kortum who is acting manager of the District. Resolution to be effective May 11, 2022. Authorized signors are as listed: Fallon Division Commissioner, Barry Rakes; Terry Division Commissioner, Jackson Dion; Shirley Division Commissioner, Lance Kalfell. All in Favor. Motion Carried.
Mr. Lance Kalfell requested that Jackson Dion be reimbursed for mileage and associated costs of his bi-weekly trips to town for payroll/check signatures and approval. It was agreed by all present that a stipend be agreed upon at the next regular meeting of the Buffalo Rapids Irrigation District No. 2 Board of Commissioners to account for Mr. Dion's additional time present for check signatures each month.
The meeting was adjourned on a
motion by Lance Kalfell, seconded by Jackson Dion. All in Favor. Motion Carried.
