MINUTES

Of the

MEETING OF THE COMMISSIONERS

Of the

BUFFALO RAPIDS IRRIGATION DISTRICT NO. 2

Terry, Montana 

May 12, 2021

 Before the meeting could be called to order, the following nominations, elections and appointments needed to be made: 

            The meeting was then turned over to Lance Kalfell who declared nominations or appointments open for Commissioner of Terry Division of the Buffalo Rapids Irrigation District No.2 with Jackson Dion being nominated and/or appointed by Lance Kalfell.  Lance Kalfell made a motion that all nominations cease, seconded Barry Rakes, and a unanimous ballot be cast for Jackson Dion.  Mr. Jackson Dion's commission was uncontested by any other opponent for the three-year term.

             A unanimous ballot was cast for Jackson Dion, and it was, 

            RESOLVED, that Jackson Dion be and he is hereby elected and appointed to the position of Commissioner of Terry Division of the Buffalo Rapids Irrigation District No. 2, to hold office until the twelfth regular meeting to be held in May of 2024 and/or until his successor is elected and qualified.

 Mr. Dion accepts his position. 

            Lance Kalfell who declared nominations or appointments open for President of the Buffalo Rapids Irrigation District No. 2.  Barry Rakes was nominated by Lance Kalfell.  Lance Kalfell made a motion, seconded by Jackson Dion, and that all nominations cease, and a unanimous ballot be cast for Barry Rakes.

             A unanimous ballot was cast for Barry Rakes, and it was,

             RESOLVED, that Barry Rakes be and he hereby is elected and appointed to the position of President of the Buffalo Rapids Irrigation District No. 2, to hold office until the twelfth regular meeting to be held in May of 2022 and/or until his successor is elected and qualified. 

            Mr. Rakes accepts his position.

             The meeting was turned back to President Barry Rakes.  President Barry Rakes declared nominations open for Vice President of the Buffalo Rapids Irrigation District No. 2 with Jackson Dion being nominated by Lance Kalfell.  Lance Kalfell made a motion, seconded by Barry Rakes, that all nominations cease, and a unanimous ballot be cast for Jackson Dion.

            A unanimous ballot was cast for Jackson Dion, and it was,

             RESOLVED, that Jackson Dion be and he is hereby elected to the position of Vice President of the Buffalo Rapids Irrigation District No. 2, to hold office until the twelfth regular meeting to be held in May of 2022 and/or until his successor is elected and qualified.

 Mr. Dion accepts his position. 

            Nominations were open for Secretary of the Buffalo Rapids Irrigation District No. 2 with Tim Kortum being nominated by Jackson Dion.  Jackson Dion made a motion, seconded by Lance Kalfell, that all nominations cease, and a unanimous ballot be cast for Tim Kortum. 

            A unanimous ballot was cast for Tim Kortum, and it was,

                       RESOLVED, that Tim Kortum be and he is hereby elected to the position of Secretary of the Buffalo Rapids Irrigation District No. 2, to hold office until the twelfth regular meeting to be held in May of 2022 and/or until his successor is elected and qualified. 

            Mr. Kortum accepts his position. 

            Nominations were open for Treasurer of the Buffalo Rapids Irrigation District No.2 with Pat Davis being nominated by Lance Kalfell.  Lance Kalfell made a motion, seconded by Jackson Dion, that all nominations cease, and a unanimous ballot be cast for Pat Davis. 

            A unanimous ballot was cast for Pat Davis, and it was, 

            RESOLVED, that Pat Davis be and she is hereby elected to the position of Treasurer of the Buffalo Rapids Irrigation District No. 2, to hold office until the twelfth regular meeting to be held in May of 2022 and/or until her successor is elected and qualified.

             Ms. Davis accepts her position.       

            All nominations being made and accepted, the First Regular Meeting of the Members of the Buffalo Rapids Irrigation District No.2, at Terry, Prairie County, Montana, was called to order, held on the 12th day of May, 2021, at 7:00 p.m.

          There were present and participating at the meeting:

            

Barry Rakes

Lance Kalfell

Jackson Dion 

 

Also present and participating were: Tim Kortum, Manager, and Pat Davis, Treasurer.

 

            President Barry Rakes called the meeting to order, stating that all necessary and advisable business be conducted during this time and that notice had been received by each Board Member.

 

            Thereupon, President Barry Rakes announced that legal notice had been given and a quorum was present so that the meeting was legally and lawfully ready to transact business.

 

            The Minutes from the April 14, 2021, Board Meeting, were approved without corrections and, or additions, by Lance Kalfell, seconded by Jackson Dion.  All in Favor.  Motion Carried

           

            FINANCIAL REPORT:

             Pat Davis presented current budget figures which included payroll and expenditures through May to all Board members for their review.  A list of invoices to be paid was submitted and forms for the Prairie County Treasurer to transfer funds in the amount of $46,719.88, to cover payroll and invoices were signed. May 15th estimated payroll: $16,622.32, May estimated invoices $15,114.79, May 31st estimated payroll: $14,982.77.  Investment transfer was signed to invest the remaining monthly District No. 2 cash balances in the amount of $406,522.52 with Prairie County Pool.  Warrant numbers from April 16, 2021 to May 13, 2021 range from 26323 to 26376. 

 

Pat Davis presented to the Board Assessment projection worksheets to assist the Buffalo Rapids Board in their review of the financials for the 2022 water season assessments.  After much discussion and consideration, the 2022 Operating Year assessments are set as follows. The amount per acre will be $55.00 per acre. 

O&M=$50.00

EQUIP RESERVE=$2.00

SYSTEM REHAB=$3.00

TOTAL=$55.00 

Jackson Dion made a motion to accept the 2022 operating year assessments, seconded by Lance Kalfell.  All in Favor.  Motion Carried

 

BE IT RESOLVED, 

            To assess $55.00 per acre for the 2022 Operating Year Assessments for Buffalo Rapids Irrigation District No. 2.

             The 2022 water overage is set as follows for the overage fee of $20.00 per acre foot. On a motion made by Jackson Dion and seconded by  Lance Kalfell it was RESOLVED,

            2022 water overage for Buffalo Rapids Irrigation District No. 2 will be a fee of     $20.00 per acre foot.  All in Favor.  Motion Carried.

 

The treasurer's report was approved on a motion by Lance Kalfell, seconded by Jackson Dion.  All in Favor.  Motion Carried.

  

MANAGER’S REPORT: 

            Mr. Tim Kortum informed all present that the 2021 water season is underway and that all the pumps and canals are running well.  Tim also reported that Pat Davis has purchased new tablets for the Water books Database that the ditch riders and herself use for the daily deliveries of water and reporting.         

 

            Tim stated that the attorney representing Buffalo Rapids District 2, concerning the Water Rights for the District, informed Tim that McAulay Ranch Co. has filed another 30 day extension in the Water Court case.  Tim will inform the members of the Board when he hears of any new updates on the on-going case.

 

            Tim spoke to all members present that they have signed the contract with the Department of Natural Resources and Conservation, for the Lateral 1.6 Pipeline Project Grant.  Funds are now available to the District.  Tim spoke with Performance Engineering and Consulting on a few communication issues and reporting requirements for the District grants.  Tim stated that he was assured things would improve.      

 

            Tim informed the District No. 2 Board of Commissioners that they are in need of a different ditch riding pickup.  He will travel to the Montana Property & Supply Bureau to purchase a vehicle for the District.

 

            The members of the Board discussed and agreed to add Jackson Dion to the list of authorized signors for Buffalo Rapids Irrigation District No. 2. On a motion made by Lance Kalfell and seconded by Barry Rakes:

 BE IT RESOLVED,

             That the Buffalo Rapids Project Irrigation District No. 2 Commissioners, be authorized to sign on all Buffalo Rapids accounts, including the Secretary of the Board Mr. Tim Kortum who is acting manager of the District. Resolution to be effective May 12, 2021. Authorized signors are as listed: Fallon Division Commissioner, Barry Rakes; Terry Division Commissioner, Jackson Dion; Shirley Division Commissioner, Lance Kalfell.

All in Favor.  Motion Carried. 

 

            The meeting was adjourned on a motion by Barry Rakes, seconded by Jackson Dion. All in Favor.  Motion Carried.
